Selling Guidelines

Auctions last 3, 5, 7, 14 or 30 days. For Sale items are listed for 30 days. The sales choice and format is at the discretion of the seller at the time of listing the item. ASSET ASSIST concludes the bidding at the end of the auction and notifies the seller and the successful bidder via e-mail.

We, at ASSET ASSIST, do not condone the selling of the following items: Illegal Items, Drugs, Counterfeit goods, Live Animals, Adult Items, Tobacco, Firearms, or anything that can cause harm to another individual/member. ASSET ASSIST does reserve the right to terminate such auctions or private sales immediately and revoke site privileges for members that attempt to sell such items.

Both Auction and For Sale results are posted to the buyer and seller via e- mail. These results indicate the final price and the buyer/highest-bidder and seller's email address. These results are available to any registered user. The buyer/highest-bidder and seller should contact each other within 3 business days of the end of the sale or auction. A seller may contact the next highest bidder(s) if, after 3 business days, the buyer has not provided proper communication. The Buyer/highest-bidder face the risk of losing integrity points and the item they bid on if the sale/purchase does not proceed. ASSET ASSIST recommends that the seller explore all shipping options, as listed in the Services Directory.

ASSET ASSIST is the auction host and listing agent only and is not involved in the actual final transaction.

Bidding/Purchasing/Information

Before placing a bid or purchasing, the potential buyer should learn as much about the seller and the item as possible. Check the seller's integrity score (icon) and make sure you find out everything you might need to know. Some of the things you might want clarified include shipping terms, payment terms, Goods and services tax, applicable duties, escrow, guarantee, item clarification, inspection details, maintenance records and history, etc.... You may wish to arrange an inspection if necessary.

Now you are ready to bid! Simply select the item from the main list and then press the bid button. We recommend Proxy Bidding where you place the maximum amount you are willing to pay for that item. This amount remains secret until the end of the auction. Bids will be made for you as necessary as other bidders increase the bid price. You will never bid more than the necessary bid increment or more than your maximum. (See Proxy Bidding example.) Identical, Bulk Inventory Auction and Reverse Auction rules are slightly different.

The earliest bids take precedence in the case of ties.

By placing a bid, the buyer is showing intention to buy. The seller agrees to dispose and the purchaser agrees to purchase at the price bid and accepted. No bid once made can be retracted. Purchasers/Sellers who infringe the ASSET ASSIST rules will be barred from the site. User ID and valid e-mail address must be proved when placing a bid (or purchasing products). The offer and acceptance form from the confirmation of highest successful bid email at close of auction/sale will be utilised by both the purchaser and seller to confirm the terms of the transaction.

Retraction of bids is allowed under exceptional circumstances only. Future use of ASSET ASSIST will be jeopardized if an individual reneges for invalid reasons.

Buyers will be notified if another bidder outbids their maximum bid.

Finalising a Sale/Buying the Item

Promptly communicate with the seller to finalise matters such as shipping, payment terms, escrow, insurance, finance, etc....Be efficient and leave feedback about your experience and the seller.

Selling at Auction or For Sale Section

It's efficient and convenient to sell items either at Auction or in the For Sale Section. Simply click on the "Sell Your Asset" on the homepage. Be descriptive and concise. You can utilize HTML tags in your item's description but not in the title. You can link to pictures if you choose, but the content linked to the item description must comply with the ASSET ASSIST User Agreement.

We recommend that you set the minimum bid at a very low price (usually about 20% of the true value of your item). This will encourage bidders to bid and will simply help initiate action at your auction. The bidding increments are determined by the amount of the current high bid. By listing an item for sale or auction, you signify your intent and ability to sell at your minimum price and/or highest bid. You are obliged to complete the transaction and a breach of this may result in being barred from the ASSET ASSIST site if a legitimate reason is not provided. Sellers must provide a valid e-mail address with each listing. Sellers may be barred from using ASSET ASSIST at our sole discretion. This will be based on too much negative feedback and/or low integrity score or listing illegal or illicit items. It's good business to be honest and forthright and will result in a positive experience for all. Sellers are not allowed to manipulate the price of any item they are selling (i.e. dummy bidding or bidding on your own items. This may result in revoked privileges from ASSET ASSIST).

Note: ASSET ASSIST recommend Sellers add 10% to all quoted prices to allow and account for GST and include this Item Description, at the time of listing.

Reserve Price Auction

Some sellers choose auctions with reserve prices when listing an item. The reserve price is the lowest price at which the seller is willing to sell an item. This price should be above the minimum bid price, where the bidding is started. The bidders never know the reserve price. If this price is not met, the seller is not obligated to sell. If a bid is equal to or greater than the reserve price, the item information will indicate the reserve price has been met and the bidder will be notified.

*The seller is required to sell the item to the highest bidder if the minimum acceptable bid is met unless the auction is a reserve price auction (then the highest bid must equal or surpass the reserve price)

Identical, Bulk Inventory Auctions

"Identical, Bulk Inventory Auctions" are a special auction format where a seller has multiple, identical items for auction. The seller specifies the minimum price (the starting bid) and the Number of items available. Bidders bid an amount for one of the items at or above the minimum for a specified quantity they are interested in purchasing. The highest bidders earn the right and are obligated to purchase the quantity of items at the successful bid amount.

The original or early bidders are treated on a "first come, first serve" basis. Therefore once an acceptable bid has been made the first bidders at the accepted price receive priority to purchase the quantity of the item they have specified in their bid.

As in all other auctions, the "Identical, Bulk Inventory Auctions" are easily followed as the current standings are displayed after the item description. The complete bidding history, including unsuccessful bids, and is available for viewing as well.

We recommend your utilisation of these services and would be eager to receive feedback on your experiences or whether other services can be added.

Feedback

ASSET ASSIST encourages feedback about your experiences with buyers and sellers. This helps others build trust in each other and form a productive trading community. Be aware that frivolous unfounded feedback can damage reputations and can result in a negative integrity score.

Registration

It is important for all to enter correct information to be an ASSET ASSIST user and member. This information is important for ASSET ASSIST and other registered users, so they contact you regarding buying or selling. Make sure you note your user ID Number. You provide this after entering correct data on your registration form. You will probably want to use this instead of your e-mail address for more privacy.

Escrow Service

Following the successful culmination of a sale/purchase, the parties to the sale/purchase may require the security of placing the purchase money into a secure, highly regarded Escrow Service. The purchase funds are placed in Trust until certain matters/conditions have been completed. For example, the purchaser may require a machine to be disconnected, crated and placed on transport, but the seller will not allow this to occur until the purchase money is secured. Enquire about Escrow Australia's services to assist in these concerns.

Item Spamming

Item Spamming is illegal at ASSET ASSIST. It is defined as:

  1. Listing items in categories that are not related to that item.OR
  2. Duplicating items in any category.OR
  3. Creating a false auction for the purpose of advertising your business/website.

The penalty for Item Spamming is a $5.50 per item administration fee to remove each item from auction, a warning and possible membership suspension.

Adult Items

ASSET ASSIST currently does not have a listing category for Adult Items. Erotica or Adult Items are not endorsed or encouraged.

TERMS AND CONDITIONS OF SALE

  1. Acceptance of Terms

    This on-line service to facilitate the sale of goods ("the Service") is operated by www Asset Assist Pty Ltd ACN 089 820 548 - ABN No. 520-898-205-48("ASSET ASSIST").

    By registering as a potential buyer of goods ("Buyer") or a potential seller of goods ("Seller") you agree to be bound by these terms and conditions.

  2. Obligations of ASSET ASSIST

    ASSET ASSIST offers the Service to promote communication between Buyers and Sellers. ASSET ASSIST takes no part in any transaction between users of the Service ("Users"). ASSET ASSIST shall not be obliged to express an opinion in relation to any property or any transaction, arbitrate any dispute nor recognise any transaction in relation to goods listed on the Service. At no stage does ASSET ASSIST own or otherwise have title to any of the goods sold by Sellers, or bought by Buyers, using the Service.

    It is the sole responsibility of the Seller, not ASSET ASSIST, to account for and collect from the purchaser/Buyer, a 10% tax when applicable, with purchase of any goods and/or services.

    ASSET ASSIST is under no obligation to confirm the identity of any Buyer or Seller, nor the location or condition of any goods.

    ASSET ASSIST reserves the right to refuse to list an item, or to recommend an alternate method of disposal of the item.

    ASSET ASSIST reserves the right to refuse or cancel a person's registration as a Buyer or a Seller and to prevent any person from gaining access to the Service.

    ASSET ASSIST may retain all information provided by Buyers and Sellers and all information in relation to the sale of items listed on the Service, and may use such information for its own purposes provided that no personal identifying information will be disclosed except that details of a Buyer may be disclosed to a potential Seller, and details of a Seller may be disclosed to a potential Buyer.

  3. Your Obligations and Acknowledgments

    All information provided by you when prompted to do so by the Service must be accurate and complete. You must ensure that this information remains accurate and complete at all times and must update all information if your circumstances change. By providing such information, you authorise ASSET ASSIST to disclose such information to third parties (other than information which specifically identifies you, unless legally required to do so).

    Sellers of goods must not place any bid, or arrange for any bid to be placed, for those goods or in any other way manipulate the sale of those goods.

    You must not act in any way which may adversely affect the operation of the Service including providing any information which contains a virus or which may otherwise affect the Service, Users of the Service or data stored by ASSET ASSIST or any Users of the Service.

    You must keep your password or other registration details secret. You will be solely responsible for any activities undertaken by third parties using your name, password or other details.

    You agree not to use the Service for illegal or fraudulent purposes or in any way that could result in criminal or civil liability. You agree not to forge communications nor take any other action that would disguise the origin of communications transmitted by you.

    You acknowledge that these terms and conditions may change from time to time and you agree to be bound by any amended terms and conditions as soon as you are notified of such amendments.

    You may cease to use the Service at any time, but will remain liable for any liability incurred prior to the time that you cease to use the Service. You agree to notify ASSET ASSIST upon ceasing to use the Service.

    You agree not to use the Service to transmit material that could be considered offensive, harassing, libellous, threatening, unlawful or otherwise objectionable, nor to transmit any such material in any way to anyone whose details are provided to you by ASSET ASSIST.

    You acknowledge that content appearing on the Service may be protected by intellectual, industrial or other proprietary or personal rights and that you will be solely responsible for any breach of such rights that may result from your use of the Service.

  4. Disclaimer of Warranties

    You expressly agree that use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. ASSET ASSIST expressly disclaims all and any warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. To the extent that legislation implies any warranties and prohibits the exclusion of such warranties, your remedies will be limited to the re-supply of services to be provided by ASSET ASSIST, or payment of the cost of supplying such services.

    ASSET ASSIST makes no warranty that the Service will meet your requirements or that the Service will be uninterrupted, timely, secure or error free. ASSET ASSIST makes no warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service (if any) will be corrected.

    Without limiting any of the disclaimers in this paragraph 4, all information provided by ASSET ASSIST or any other party in relation to the assessment of any goods listed for sale (whether by way of valuation, appraisal or otherwise) is provided as a guide only. You agree that you will not act in reliance upon this information and that you will make your own independent enquiries as to the quality, condition and value of the goods.

    No advice or information, whether oral or written, obtained by you from or through the Service shall create any warranty not expressly made herein.

  5. Limitation of Liability

    ASSET ASSIST shall in no way be liable for any direct, indirect, incidental, special or consequential damages:

    (a) That result directly or indirectly from the use or the inability to use the Service, or for the cost of procuring substitute goods or services;

    (b) That result directly or indirectly from any goods or services purchased or obtained, or messages received or transactions entered into, through the Service; or

    (c) That result directly or indirectly from unauthorised access to or alteration of a User's transmission or data,

    including but not limited to, damages for loss of profits, use, data or other intangibles, whether or not ASSET ASSIST has been advised of the possibility of such damages.

  6. Release and Indemnity

    You hereby waive, release, forgive, discharge and relinquish any and all claims that you have or may have against ASSET ASSIST, its officers, employees and agents which are connected with, arise from, or are incidental to the Service.

    You will at all times indemnify and keep indemnified ASSET ASSIST and its officers, employees and agents from and against any loss (including legal costs and expenses) or liability incurred by ASSET ASSIST or its officers, employees or agents arising from any claim, demand, suit, action or proceeding by any person due to or arising (whether directly or indirectly and whether wholly or in part) out of your use of the Service or any actions incidental to your use of the Service.

  7. Termination

    ASSET ASSIST reserves the right to terminate your access to and use of the Service at any time.

  8. Advertising

    ASSET ASSIST may make online advertising available to Users. You acknowledge that any statements, representations or other information made available in any such advertising is provided solely by the relevant advertiser and that ASSET ASSIST does not warrant the completeness or accuracy of any such statements, representations or other information.

  9. Good and Services Tax

    It is the responsibility of the Seller to account for and collect from the purchaser/Buyer, a 10% tax when applicable, with purchase of any goods and/or services.

    A 10% GST has been assessed and is included in invoicing for all relevant fees to ASSET ASSIST, though the use of the ASSET ASSIST website.

  10. Governing Laws

    The terms and conditions will be governed by and construed in accordance with the laws of the State of Victoria, Australia and you agree to submit to the exclusive jurisdiction of the courts of that State.
